Update on sulfoxaflor

“Following up on some questions that came up during my talk in Cleveland last month at the North Central Integrated Pest Management Center Stakeholder Panel meeting (and in some conversations later in the meeting) about the recent court decision concerning sulfoxaflor (Dow AgroSciences trade names Closer™SC and Transform™WG),” said Dibblee. The U.S. EPA Office of Pesticide Programs has released the following statement:

“The United States District Court for the Central District of California vacated the Environmental Protection Agency’s registration of sulfoxaflor, and remanded the registration decision to EPA. We are reviewing the opinion in consultation with the Department of Justice to determine our next steps. The Court’s decision won’t take effect until it issues its mandate, which will not happen before Nov. 1. Until the mandate issues, all activities that were previously authorized under the registration remain lawful, and we do not know what the court’s mandate will say.”

Dibblee said, “I realize that this isn’t altogether helpful, but it’s all we have for the time being.  For example, the statement doesn’t address state registrations under FIFRA Section 18.  I will post an update on this topic as soon as I learn more; please feel free to call me if a question comes up in the meantime.”
